Tobacco as a product is already heavily regulated, with new rules being proposed constantly. Just this past month, the <a href=\"https:\/\/www.cnn.com\/2022\/06\/23\/health\/juul-taken-off-market-fda\/index.html#:~:text=(CNN)%20The%20US%20Food%20and,selling%20and%20distributing%20these%20products.\" target=\"_blank\" rel=\"noreferrer noopener\">FDA ordered Juul products off the market<\/a>, concerning many smokers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In an ongoing lawsuit concerning the FDA&#8217;s attempt to more closely regulate the premium cigar market, the federal judge overseeing the case has largely sided with cigar manufacturers. The judge has invited further briefing before issuing a final ruling on July 26 but has called the FDA&#8217;s attempt to impose new restrictions on cigars &#8220;arbitrary and capricious&#8221;. <\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"612\" height=\"408\" src=\"https:\/\/mikescigars.com\/blog\/wp-content\/uploads\/istockphoto-674803164-612x612-1.jpg\" alt=\"\" class=\"wp-image-34582\"\/><figcaption>A group of happy smokers<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">The judge further stated &#8220;The agency\u2019s statement that \u2018all cigars produce toxic smoke\u2019 is exactly the sort of nonresponsive, circular reasoning the court faulted previously.\u00a0Instead of addressing the\u00a0relevant data before it, the agency resorted to a common refrain to obscure the issue,\u201d he wrote, referring to the FDA&#8217;s claim that there was no data provided to support the idea that there are different patterns of use among premium cigar smokers, patterns that result in lower health risks.
